شروط الاستخدام والبيع

تنظّم هذه الشروط استخدامك لموقع noirix.shop وتطبيقات NOIRIX، وأي شراء منها. باستخدام المتجر أو إتمام طلب، توافق على هذه الشروط وعلى سياسة الإلغاء والإرجاع والاسترداد وسياسة الشحن والتوصيل وسياسة الخصوصية، وهي جزء لا يتجزأ منها. اقرأها جيداً، واحفظ نسخة منها.

إذا كنت مستهلكاً، فلا شيء في هذه الشروط ينتقص من حقوقك القانونية، بما فيها حقوقك بموجب قانون حقوق المستهلك البريطاني لعام 2015 ولائحة عقود المستهلك لعام 2013.

1. من نحن وكيف تتواصل معنا

NOIRIX اسم تجاري لشركة RIVAL SHOP LTD، شركة خاصة محدودة بالأسهم مسجّلة في إنجلترا وويلز برقم 16752484، وعنوانها المسجّل: 71-75 Shelton Street, Covent Garden, London WC2H 9JQ, United Kingdom (عنوان إداري لا يستقبل البضائع).

عندما نقول «كتابياً» في هذه الشروط فالبريد الإلكتروني يكفي.

2. الأهلية

يجب أن يكون عمرك 18 عاماً أو أكثر وأهلاً لإبرام العقود، أو أن تستخدم المتجر بإشراف ولي أمر.
المتجر مخصص للشراء الشخصي للمستهلكين. إذا أردت الشراء لأغراض تجارية أو بكميات كبيرة، راسلنا أولاً.
تتعهد بأن المعلومات التي تقدمها صحيحة وكاملة ومحدّثة.

3. الحساب

يمكنك الشراء كزائر أو بإنشاء حساب.
أنت مسؤول عن سرية كلمة المرور وعن كل نشاط يتم عبر حسابك. استخدم كلمة مرور قوية لا تستخدمها في مكان آخر.
أبلغنا فوراً على support@noirix.shop إن اشتبهت في استخدام غير مصرح به.
يحق لنا تعليق حساب أو إغلاقه إذا استُخدم بشكل مخالف لهذه الشروط أو للقانون، أو للاحتيال، مع إبلاغك وسبب ذلك متى سمح القانون.
يمكنك إغلاق حسابك في أي وقت بمراسلتنا.

4. الطلبات وإبرام العقد

عرض المنتجات في المتجر دعوة للشراء وليس عرضاً ملزماً.
عند الضغط على زر الدفع، تقدم عرضاً لشراء المنتجات في سلتك بالسعر المعروض.
نرسل لك رسالة تأكيد استلام الطلب. هذه الرسالة لا تعني قبول الطلب.
يُبرم العقد عندما نرسل لك رسالة تأكيد شحن الطلب. إذا شُحن الطلب على عدة طرود، يُبرم العقد لكل منتج عند شحنه.
قبل الشحن، يحق لنا رفض الطلب أو إلغاؤه كلياً أو جزئياً، مثلاً عند: نفاد المنتج، أو خطأ واضح في السعر أو الوصف، أو تعذّر التحقق من الدفع أو الهوية، أو الاشتباه في احتيال أو إعادة بيع، أو تعذّر الشحن إلى عنوانك، أو قيود قانونية. نبلغك ونرد كامل المبلغ المدفوع عن المنتجات الملغاة.

5. الأسعار والسعر الكامل

نعرض الأسعار بعملة بلدك أو العملة التي تختارها، ونعرض السعر الكامل شاملاً الرسوم الإلزامية التي نعرفها مسبقاً.
المبلغ النهائي المستحق هو المعروض في صفحة الدفع قبل التأكيد، ويشمل سعر المنتجات والشحن والضرائب والرسوم التي نحصّلها، مع توضيح ما إذا كانت ضرائب ورسوم الاستيراد مشمولة.
قد تختلف الأسعار بين الدول بسبب تكاليف الشحن والضرائب والرسوم والعملة.
قد نغير الأسعار في أي وقت، لكن التغيير لا يؤثر على طلب أكدته.
إذا اكتشفنا خطأ واضحاً في السعر (يمكن أن يلاحظه أي شخص بشكل معقول)، نتواصل معك لتختار المتابعة بالسعر الصحيح أو الإلغاء مع استرداد كامل، ولا نلزمك بالسعر الخاطئ.
قد يفرض بنكك رسوم تحويل عملة أو رسوماً دولية لا نتحكم بها.

6. العروض وأكواد الخصم

لكل عرض شروطه ومدته المعلنة. لا تُجمع العروض ما لم يُذكر ذلك صراحة.
أكواد الخصم شخصية، ولا تُستبدل نقداً، ولا يجوز بيعها أو نشرها دون إذن، وقد نلغي أي خصم استُخدم بالمخالفة لشروطه.
نعرض «السعر السابق» فقط إذا كان المنتج معروضاً فعلاً بذلك السعر لفترة معقولة قبل التخفيض.

7. الدفع

يتم الدفع عبر صفحة الدفع الآمنة من Shopify، بالوسائل المتاحة في بلدك والمعروضة عند الدفع.
يُخصم المبلغ عند تأكيد الطلب. لا نخزّن بيانات بطاقتك.
قد نتحقق من بعض الطلبات قبل شحنها لحمايتك من الاحتيال، وقد نطلب منك معلومات إضافية.

8. المنتجات ووصفها وسلامتها

نحرص على دقة الصور والأوصاف والمقاسات والمواد. قد تختلف الألوان قليلاً حسب شاشة جهازك، وقد يختلف التغليف عن الصور.
جداول المقاسات إرشادية وتختلف بين المنتجات. راجعها قبل الطلب، وراسلنا عند الشك.
اقرأ التعليمات والتحذيرات المرفقة بكل منتج والتزم بها. لمستحضرات التجميل والعناية: نوصي باختبار حساسية على مساحة صغيرة من الجلد قبل الاستخدام الكامل، والتوقف عند أي تهيّج. للمشدات والكورسيهات وملابس التشكيل: اتبع إرشادات المقاس والارتداء، ولا تشدّها بشكل يعيق التنفس أو الحركة، ولا ترتديها لفترات طويلة متواصلة، واستشر طبيباً إن كانت لديك حالة صحية أو حمل.
المنتجات للاستخدام الشخصي المعتاد. لا تستخدمها لغير الغرض المقصود منها.
إذا علمنا أن منتجاً قد يكون غير آمن، نوقف بيعه ونتواصل مع المشترين وننسق الإجراء المناسب (إصلاح أو استبدال أو استرداد) وفق القانون.

9. التوافر

جميع المنتجات معروضة حسب التوافر. إذا نفد منتج بعد طلبك، نبلغك ونرد ثمنه كاملاً، أو نقترح بديلاً مماثلاً إن رغبت.

10. الشحن والملكية والمسؤولية

تُطبّق سياسة الشحن والتوصيل. تنتقل المسؤولية عن المنتجات إليك عند وصولها إلى حيازتك أو حيازة من تحدده، وتنتقل ملكيتها إليك عند استلامنا كامل الثمن.

11. الإلغاء والإرجاع والضمان القانوني

تُطبّق سياسة الإلغاء والإرجاع والاسترداد. نحن ملزمون قانوناً بتوفير منتجات مطابقة لهذا العقد. إذا كان المنتج معيباً أو غير مطابق، تتمتع بالحقوق القانونية الموضحة في تلك السياسة، ولا تُستبدل هذه الحقوق بأي ضمان تجاري.

12. المراجعات والمحتوى الذي تنشره

نرحب بالمراجعات الصادقة عن منتجات اشتريتها أو استخدمتها فعلاً.
لا ننشر مراجعات مزيفة، ولا نطلبها أو ندفع مقابلها، ولا نخفي المراجعات السلبية الصادقة. إذا قدمنا حافزاً مقابل مراجعة، نوضح ذلك بجانبها.
يُمنع نشر محتوى مسيء أو مضلل أو غير قانوني أو منتهك لحقوق الآخرين أو يتضمن بيانات شخصية لغيرك. يحق لنا إزالة أي محتوى مخالف.
بنشر مراجعة أو صورة، تمنحنا ترخيصاً غير حصري ومجانياً لعرضها في متجرنا وقنواتنا مع اسمك المختصر، ويمكنك طلب حذفها في أي وقت.

13. الملكية الفكرية

اسم NOIRIX وشعاره وتصميم المتجر وواجهاته ونصوصه وصوره الأصلية ورموزه البرمجية ملك لنا أو مرخصة لنا ومحمية بالقانون. يُسمح لك بتصفحها للاستخدام الشخصي فقط، ولا يجوز نسخها أو تعديلها أو إعادة نشرها أو استخدامها تجارياً دون إذن كتابي. أسماء العلامات التجارية الأخرى ملك لأصحابها.

14. الاستخدام المقبول

يُمنع عليك:

استخدام المتجر لأي غرض غير قانوني أو احتيالي، أو بهوية غيرك.
محاولة اختراق المتجر أو أنظمته أو تعطيلها، أو إدخال برمجيات ضارة، أو تجاوز إجراءات الأمان.
جمع البيانات أو الأسعار آلياً (Scraping) أو استخدام برامج آلية للشراء دون إذن كتابي.
إعادة بيع منتجاتنا بطريقة توحي بأنك NOIRIX أو وكيل معتمد لنا.
إساءة استخدام سياسة الإرجاع أو العروض بشكل متكرر ومتعمد.

15. الروابط والخدمات الخارجية

قد يحتوي المتجر على روابط لمواقع أو خدمات أخرى (مثل تتبع الشحن أو وسائل الدفع). هذه الخدمات تخضع لشروطها، ولسنا مسؤولين عن محتواها.

16. توافر الموقع

نعمل على إتاحة المتجر دائماً، لكن قد يتوقف مؤقتاً للصيانة أو لأسباب تقنية. لا نضمن خلو المتجر من الأخطاء في كل الأوقات، ونصلحها حال علمنا بها.

17. المسؤولية

إذا أخللنا بهذه الشروط أو أهملنا، نتحمل مسؤولية الخسائر والأضرار التي تلحق بك والتي كانت متوقعة بشكل معقول وقت إبرام العقد.
لا نستبعد ولا نحد من مسؤوليتنا عن: الوفاة أو الإصابة الشخصية الناتجة عن إهمالنا، أو الاحتيال أو التضليل الاحتيالي، أو الإخلال بحقوقك القانونية المتعلقة بالمنتجات (مثل المطابقة للوصف والجودة المُرضية والصلاحية للغرض)، أو المنتجات المعيبة بموجب قانون حماية المستهلك لعام 1987، أو أي مسؤولية لا يجوز قانوناً استبعادها.
نزوّد المنتجات للاستخدام المنزلي والشخصي. لسنا مسؤولين عن خسارة الأرباح أو الأعمال أو الفرص التجارية لمن يشتري لأغراض تجارية.
لسنا مسؤولين عن الأضرار الناتجة عن استخدام المنتج بشكل مخالف للتعليمات أو التحذيرات المرفقة به.

18. الظروف الخارجة عن إرادتنا

لا نتحمل مسؤولية التأخير أو التعذر الناتج عن أحداث خارجة عن سيطرتنا المعقولة، كالكوارث الطبيعية والأوبئة والحروب والإضرابات وتعطل شبكات الشحن أو الإنترنت والقيود الحكومية. نبلغك ونعمل على تقليل الأثر، ويحق لك الإلغاء واسترداد ما دفعته عن المنتجات التي لم تصلك إذا طال التأخير.

19. الشكاوى وحل النزاعات

راسل support@noirix.shop موضحاً المشكلة ورقم الطلب. نؤكد الاستلام خلال يومي عمل، ونسعى لحل الشكوى خلال 14 يوماً.
إذا لم نصل إلى حل، يمكنك اللجوء إلى جهات حماية المستهلك في بلدك أو إلى المحاكم المختصة.

20. القانون الحاكم والاختصاص

تخضع هذه الشروط لقوانين إنجلترا وويلز. إذا كنت مستهلكاً مقيماً في اسكتلندا أو أيرلندا الشمالية، يمكنك رفع الدعوى أمام محاكم بلدك. وإذا كنت مستهلكاً مقيماً في الاتحاد الأوروبي أو أي دولة أخرى، تستفيد أيضاً من الحماية الإلزامية في قانون بلدك، ويحق لك رفع الدعوى أمام محاكمها.

21. أحكام عامة

التعديل: قد نحدّث هذه الشروط. تُطبّق على طلبك الشروط السارية وقت تقديمه.
قابلية الفصل: إذا اعتُبر أي بند غير صالح، تبقى البنود الأخرى سارية.
عدم التنازل: عدم مطالبتنا بحق فوراً لا يعني تنازلنا عنه.
النقل: يجوز لنا نقل حقوقنا والتزاماتنا بموجب هذه الشروط إلى جهة أخرى، مع إبلاغك وضمان ألا يمس ذلك حقوقك. لا يجوز لك نقل حقوقك دون موافقتنا الكتابية.
الأطراف الثالثة: هذا العقد بينك وبيننا فقط، ولا يحق لأي طرف آخر إنفاذه.
اللغة: تُنشر هذه الشروط بالعربية والإنجليزية. عند أي اختلاف في التفسير، يُعتمد التفسير الأنسب لك كمستهلك.

These terms govern your use of noirix.shop and the NOIRIX apps, and any purchase from them. By using the store or placing an order, you agree to these terms and to our Cancellation, Returns & Refund Policy, Shipping & Delivery Policy and Privacy Policy, which form part of them. Please read them carefully and keep a copy.

If you are a consumer, nothing in these terms affects your statutory rights, including your rights under the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013.

1. Who we are and how to contact us

NOIRIX is a trading name of RIVAL SHOP LTD, a private company limited by shares registered in England and Wales, company no. 16752484, registered office: 71-75 Shelton Street, Covent Garden, London WC2H 9JQ, United Kingdom (an administrative address that does not accept goods).

When these terms say "in writing", email is enough.

2. Eligibility

You must be 18 or over and able to enter into contracts, or use the store under the supervision of a parent or guardian.
The store is for personal consumer purchases. If you want to buy for business purposes or in bulk, please contact us first.
You confirm that the information you give us is accurate, complete and up to date.

3. Accounts

You may buy as a guest or create an account.
You are responsible for keeping your password confidential and for all activity under your account. Use a strong password you do not use elsewhere.
Tell us immediately at support@noirix.shop if you suspect unauthorised use.
We may suspend or close an account used in breach of these terms or the law, or for fraud, telling you and our reasons where the law allows.
You may close your account at any time by contacting us.

4. Orders and contract formation

Products shown in the store are an invitation to buy, not a binding offer.
When you press the payment button, you make an offer to buy the items in your cart at the price shown.
We send you an email acknowledging your order. This email does not mean your order is accepted.
The contract is formed when we email you confirming your order has shipped. If your order ships in several parcels, the contract for each item is formed when it ships.
Before shipping, we may decline or cancel an order in whole or in part, for example if an item is out of stock, there is an obvious pricing or description error, we cannot verify payment or identity, we suspect fraud or resale, we cannot ship to your address, or legal restrictions apply. We tell you and refund everything you paid for the cancelled items.

5. Prices and total price

We show prices in your local currency or the currency you select, and we show the total price including mandatory charges we know in advance.
The final amount due is the one shown at checkout before you confirm, including the price of the goods, shipping, and any taxes and charges we collect, with a clear statement of whether import taxes and duties are included.
Prices may differ between countries because of shipping costs, taxes, duties and currency.
We may change prices at any time, but changes do not affect orders you have already confirmed.
If we find an obvious pricing error (one you could reasonably have recognised), we contact you so you can proceed at the correct price or cancel for a full refund; we do not hold you to the wrong price.
Your bank may charge currency conversion or international fees outside our control.

6. Offers and discount codes

Each offer has its own stated terms and duration. Offers cannot be combined unless expressly stated.
Discount codes are personal, have no cash value, may not be sold or published without permission, and we may cancel a discount used in breach of its terms.
We show a "was" price only if the item was genuinely offered at that price for a reasonable period before the reduction.

7. Payment

Payment is made through Shopify's secure checkout, using the methods available in your country and shown at checkout.
Payment is taken when you confirm your order. We do not store your card details.
We may check some orders before shipping to protect you from fraud, and may ask you for further information.

8. Products, descriptions and safety

We take care to make images, descriptions, sizes and materials accurate. Colours may vary slightly depending on your screen, and packaging may differ from images.
Size charts are a guide and vary between products. Check them before ordering and contact us if unsure.
Read and follow the instructions and warnings supplied with each product. For cosmetics and skincare: we recommend a small patch test before full use, and stop if irritation occurs. For corsets, waist trainers and shapewear: follow sizing and wearing guidance, do not tighten in a way that restricts breathing or movement, do not wear for long continuous periods, and consult a doctor if you have a medical condition or are pregnant.
Products are for normal personal use. Do not use them for purposes other than those intended.
If we learn that a product may be unsafe, we stop selling it, contact buyers and arrange the appropriate remedy (repair, replacement or refund) as the law requires.

9. Availability

All products are subject to availability. If an item becomes unavailable after you order, we tell you and refund it in full, or suggest a similar alternative if you wish.

10. Delivery, ownership and risk

Our Shipping & Delivery Policy applies. Responsibility for the goods passes to you when they come into the possession of you or a person you nominate, and ownership passes to you once we have received full payment.

11. Cancellation, returns and statutory rights

Our Cancellation, Returns & Refund Policy applies. We are under a legal duty to supply products that conform with this contract. If a product is faulty or does not conform, you have the statutory rights set out in that policy, and no commercial guarantee replaces them.

12. Reviews and content you post

We welcome honest reviews of products you have actually bought or used.
We do not publish fake reviews, commission or pay for them, or suppress genuine negative reviews. If we give any incentive for a review, we say so next to it.
You must not post content that is offensive, misleading, unlawful, infringes others' rights, or contains other people's personal data. We may remove any content that breaks these rules.
By posting a review or photo, you give us a non-exclusive, royalty-free licence to show it in our store and channels with your shortened name, and you may ask us to remove it at any time.

13. Intellectual property

The NOIRIX name and logo, the store design and interfaces, and our original text, images and code are owned by or licensed to us and protected by law. You may browse them for personal use only, and may not copy, modify, republish or use them commercially without written permission. Other brand names belong to their owners.

14. Acceptable use

You must not:

use the store for any unlawful or fraudulent purpose, or under another person's identity;
attempt to hack or disrupt the store or its systems, introduce malicious code, or bypass security measures;
scrape data or prices or use automated purchasing tools without written permission;
resell our products in a way that suggests you are NOIRIX or an authorised agent;
repeatedly and deliberately abuse our returns policy or offers.

15. Third-party links and services

The store may link to other websites or services (such as shipment tracking or payment methods). They are governed by their own terms, and we are not responsible for their content.

16. Site availability

We work to keep the store available, but it may be unavailable temporarily for maintenance or technical reasons. We do not guarantee the store is error-free at all times, and we fix errors as soon as we become aware of them.

17. Our liability

If we breach these terms or are negligent, we are responsible for loss or damage you suffer that was reasonably foreseeable when the contract was made.
We do not exclude or limit our liability for death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; breach of your statutory rights in relation to goods (including description, satisfactory quality and fitness for purpose); defective products under the Consumer Protection Act 1987; or any liability that cannot lawfully be excluded.
We supply products for domestic and private use only. We are not liable for loss of profit, business or business opportunity where you buy for business purposes.
We are not liable for damage caused by using a product contrary to its instructions or warnings.

18. Events outside our control

We are not responsible for delay or failure caused by events beyond our reasonable control, such as natural disasters, epidemics, war, strikes, carrier or internet network failures, and government restrictions. We tell you and work to minimise the impact, and you may cancel and receive a refund for goods not yet delivered if the delay is long.

19. Complaints and disputes

Email support@noirix.shop explaining the problem and your order number. We acknowledge within two working days and aim to resolve complaints within 14 days.
If we cannot resolve it, you may contact consumer protection bodies in your country or the competent courts.

20. Governing law and jurisdiction

These terms are governed by the laws of England and Wales. If you are a consumer living in Scotland or Northern Ireland, you may bring proceedings in your local courts. If you are a consumer living in the European Union or any other country, you also benefit from the mandatory protections of your local law and may bring proceedings in its courts.

21. General

Changes: we may update these terms. The terms in force when you place your order apply to that order.
Severability: if any provision is found invalid, the rest remain in force.
No waiver: if we do not enforce a right immediately, we do not give it up.
Transfer: we may transfer our rights and obligations under these terms to another organisation, telling you and ensuring your rights are not affected. You may not transfer your rights without our written consent.
Third parties: this contract is between you and us only, and no other person may enforce it.
Language: these terms are published in Arabic and English. If the versions differ, the interpretation most favourable to you as a consumer applies.
